The builders have informed us that due to increased prices
of almost all building materials the prices for new buildings will be increased
substantially. Of course these increases will not affect any deals already
made, but will only affect new sales.

New monthly land rent

Instead of buying the full rights on the land whereby to
your choice you can obtain the freehold or the lease hold we have now
introduced a new revolutionary system, which makes that you can avoid investing
in the land. Instead of purchasing the full rights you pay a monthly rent of 0.5%
of the land value per month. This is only 6% on the investment, more than 2%
lower than the cheapest commercial mortgage interest rates in Thailand. Still
on any given time you have the right to change to purchase of the full rights
and opt for freehold or lease-hold
The price of purchasing the full rights of the land will be
adapted to the general price indexes once every two years, for the first time
in 2010.
This rental system is valid for all new sales from now on for
the projects Devalon and Summerland, from now on. If the introduction is
successful we will introduce this system on other projects as well.

Up till today we have only 6 candidates for the Resident’s
Committee on Avalon. We will send you their information shortly, together with
a voting form. Again we would like to express that it is important that the
residents make their own choices and it is in your own interest to have a
strong representation of all residents. If you feel like stepping in, wherever
you live and stay, please let it be known.
Illegal building (0810)
All buyers have a written agreement not to change the
exterior of the house, but we are constantly confronted with people who put
builders to work. If we do not know who is on the project, we have a serious
security risk. Also our builder is responsible for some types of road damage
and we cannot guarantee roads if residents come in with heavy trucks. Some
terraces are built not only horrifically ugly, but also without any foundation,
so you might expect fast deterioration. The structures interfere with building
regulations and obstruct the natural running off of rain water. Together with
the Municipality we have decided to make a list of the illegal buildings which
were not checked prior or during the building. Furthermore we will require
payment for road damage on every plot that has had illegal construction. We do
not even have to think about building guarantees, as the builder has explicitly
no repair duties if the house in any way or form is changed by the resident.
This behaviour is quite irresponsible and could lead to damages for the other
residents and new buyers, who expect to buy a guaranteed quality instead of a
sinking terrace.
We will try to remove all illegal builders from the site. We
have just had a builder arrested on Summerland, stealing from a resident. We
hope you understand our hard response. We are happy to assist any resident who
wants to build, but not without a drawing and not without us knowing who comes
to the site.
Although all these structures are not allowed according to
the contracts we are hesitant to go to court as there is a chance that the
Residents later together will decide to allow these structures.
Once the Resident’s Committee is active we will together
with them decide how to handle the existing illegal constructions. In our view
the least thing we must do, is to warn buyers of their houses that their
terraces are not built to the standard construction qualifications.
